What is an independent contractor agreement?

An independent contractor agreement is used when a business wants to hire a contractor from outside their company to perform different types of services for a limited period of time. An independent contractor may be hired to provide either specific or a broad range of services for your company for an agreed upon fee.

Using independent contractors like consultants, programmers, writers, etc can be of great benefit to your company and save a considerable amount of money.

However, it is important that you understand and clearly distinguish between an independent contractor and an employee. Some businesses may classify workers as independent contractors when in fact they should be considered and treated as employees. And certain businesses may also wrongly classify independent contractors as employees.

There are considerable tax differences between employees and independent contractors and the IRS has specific guidelines to determine how to classify both employees and independent contractors. Should a company not classify the worker properly they could suffer significant tax consequences and penalties from the IRS. Furthermore, it is also possible that a wrong classification could cause additional problems and risks to company pension plans and other employee benefits.

Employment and tax laws are always changing; do not rely on outdated independent contractor agreements and old information.

Our current CPA / Attorney drafted independent contractor’s agreement will help your business establish a worker as an independent contractor and reduce chances of IRS compliance problems.
